Terms and Conditions

1. Introduction+

By accessing or using Near Nerd's website, services, or physical location, you agree to these Terms and Conditions ("Terms"). If you do not agree with these Terms, please do not use our site or services.

2. Services Provided+

Near Nerd offers mobile device repairs, tech support, retail device sales, digital marketing, POS/business solutions, bill payment, engraving, and additional technology-related services. Service details and pricing are available on our website, in-store, or by request.

3. Customer Responsibilities+

Before Service:

  • Customers must remove SIM cards, memory cards, cases, screen protectors, and all personal accessories before leaving devices for service
  • Customers are solely responsible for backing up all data, contacts, photos, apps, and personal information prior to service
  • Customers should disable security features (passcodes, Face ID, Touch ID, Find My Device, etc.) to facilitate repair work
  • Customers must provide accurate contact information and device passwords if required for diagnostic purposes

Data Protection:

  • Near Nerd strongly recommends creating a complete backup of your device before service
  • Near Nerd is not responsible for any data loss, corruption, or unauthorized access during the repair process
  • Customers acknowledge that data recovery is not guaranteed and may not be possible

4. Diagnosis and Repair Approval+

Diagnostic Process:

  • Initial diagnostics may reveal additional issues requiring further investigation
  • Some complex issues may require extended diagnostic time, which may incur additional costs
  • Repair costs may be adjusted based on diagnostic findings and actual parts/labor required

Approval Required:

  • Written or verbal approval is required before any repair work begins
  • Customers will be contacted for approval if additional repairs or costs are discovered during service
  • If approval is not received within 48 hours, Near Nerd reserves the right to halt work and return the device in its current condition

5. Warranty Policy+

Screen Replacements

Lifetime warranty on parts and workmanship for all screen replacements. This warranty covers defects in materials or installation but does not include damage resulting from accidents, misuse, abuse, or liquid damage.

Battery Replacements

3-month limited warranty on parts and workmanship for battery replacements.

Used Phones & Other Repairs

All used phones and other repairs are covered by a 3-month limited warranty on parts and labor, unless otherwise specified at time of sale or service.

General Warranty Conditions

  • Warranties do not cover physical damage, water/liquid damage, normal wear and tear, or unauthorized modification or repair after our service
  • Warranty claims require proof of original purchase/service and may be subject to technical inspection
  • The lifetime screen warranty applies only to the original purchaser and is non-transferable
  • Warranty work must be performed by Near Nerd to maintain coverage

6. Third-Party Parts and Materials+

Parts Policy:

  • Near Nerd may use Original Equipment Manufacturer (OEM), aftermarket, or refurbished parts depending on availability and customer preference
  • Part type will be disclosed at time of service estimate
  • Aftermarket and refurbished parts may have different warranty coverage than OEM parts
  • Customers may request specific part types, subject to availability and additional costs

Quality Standards:

  • All parts meet or exceed industry standards for quality and compatibility
  • Near Nerd stands behind all parts used with the warranties specified above

7. Deposit Policy+

When Required:

  • Deposits may be required for special orders, custom parts, or high-value repairs
  • Deposit amount will be clearly communicated at time of service agreement

Refund Policy:

  • Deposits for completed services are non-refundable and applied to final invoice
  • Deposits for cancelled services may be refunded minus any restocking fees or costs incurred
  • Special order parts deposits are non-refundable once parts are ordered

8. Refunds and Exchanges+

Sales Policy:

  • All sales of pre-owned (used) devices and accessories are final — no refunds
  • New products may be governed by manufacturer warranty and return policies

Exchange Policy:

  • Pre-owned devices found not to be working (excluding damage caused by liquid, misuse, or physical abuse) within the warranty period may be exchanged for a similar device
  • No exchanges for issues resulting from water/liquid damage, misuse, or unauthorized modifications
  • All exchanges require original proof of purchase and device must be returned in same condition as sold (except for reported defect)

9. Purchases and Payments+

  • All prices are in Canadian Dollars and subject to applicable taxes (GST/PST)
  • Payment is due upon receipt of service or product
  • Accepted payment methods include cash, debit, and major credit cards

10. Device Pickup and Abandoned Property+

Pickup Policy:

  • Devices not picked up within 30 days of repair completion notification will be subject to daily storage fees
  • After 60 days, devices may be considered abandoned property

Abandoned Devices:

  • Devices unclaimed after 60 days may be sold, recycled, or disposed of to recover costs in compliance with Alberta provincial law
  • Customers will receive written notice before disposal
  • Near Nerd is not responsible for data on abandoned devices

11. Privacy and Data Handling+

Data Protection:

  • Customer data is handled confidentially and only accessed when necessary for repair purposes
  • Personal information is not shared with third parties except as required by law
  • Device data may be accessed only to complete requested services or diagnostics
  • Customers consent to necessary data access by bringing devices for service

Privacy Commitment:

  • Near Nerd does not retain copies of customer data
  • All customer information is kept confidential and secure
  • Data handling complies with applicable privacy legislation

12. Limitation of Liability+

General Limitations:

  • Near Nerd is not responsible for indirect, incidental, or consequential damages, including but not limited to loss of data, loss of income or profit, or property loss
  • Our total liability is limited to the cost of services provided
  • Customers acknowledge that electronic devices carry inherent risks during repair

Data Responsibility:

  • Data backup is customer responsibility—Near Nerd is not liable for data loss
  • Customers use services at their own risk regarding data preservation

13. Use of Website and Intellectual Property+

  • All website content, including text, images, and logos, is owned or licensed by Near Nerd
  • Content may not be copied, reproduced, or used for commercial purposes without written consent
  • Trademarks and copyrights remain property of respective owners

14. Errors and Omissions+

  • Product descriptions, prices, and availability information are subject to correction without notice
  • Near Nerd reserves the right to correct errors in pricing or product information
  • Orders based on incorrect information may be cancelled or adjusted

15. Dispute Resolution+

Governing Law:

  • These Terms are governed by the laws of the Province of Alberta, Canada
  • Any legal disputes will be resolved in Alberta provincial courts

Alternative Resolution:

  • Near Nerd encourages resolution of disputes through direct communication
  • Mediation or arbitration may be pursued before court proceedings if both parties agree

16. Changes to Terms+

Near Nerd reserves the right to modify these Terms at any time. Updates will be posted on this page with a revised effective date. Continued use of services after changes constitutes acceptance of new Terms.

17. Severability+

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
